Online Store Regulations
§ 1
Introductory Provisions
- The GRELKAM online store is run by Kamil Grelewski, a sole proprietor under the name Firma Handlowo-Usługowa GRELKAM Kamil Grelewski, entered into the Central Register and Information on Business Activity (CEIDG) maintained by the minister responsible for the economy, NIP: 8982124296, REGON: 020624222.
- These Regulations are addressed to both Consumers and Entrepreneurs using the Store. It specifies the rules for using the Online Store and the rules and procedure for concluding Sales Agreements with the Customer remotely via the Store.
§ 2
Definitions
- Consumer - a natural person concluding a contract with the Seller within the Store, the subject of which is not directly related to their business or professional activity.
- Seller - a natural person conducting business activity under the name of Firma Handlowo-Usługowa GRELKAM Kamil Grelewski, entered into the Central Register and Information on Business Activity (CEIDG) maintained by the minister responsible for the economy, NIP: 8982124296, REGON: 020624222.
- Customer - any entity making purchases through the Store.
- Entrepreneur - a natural person, legal person, or organizational unit without legal personality, to which a separate act grants legal capacity, conducting business activity on its own behalf, which uses the Store.
- Store - an online store operated by the Seller at the Internet address www.grelkam.pl
- Distance Contract - a contract concluded with the Customer as part of an organized system of concluding distance contracts (within the Store), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the contract.
- Terms and Conditions - these Store regulations.
- Order - an action, declaration of intent of the Customer directly aimed at concluding a Product Sales Agreement with the Seller and providing a service to the Customer, under the terms and conditions specified in these Regulations.
- Order Form - an interactive form available in the Store enabling the placement of an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.
- Consumer Rights Act - the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended).
- Civil Code - the Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended).
- Act on the Provision of Electronic Services - the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended).
- Shopping Cart – a software element of the Store, which displays the Products selected by the Customer for purchase, and also allows for determining and modifying the Order data, in particular the quantity of products.
- Product – a movable item/service available in the Store that is the subject of the Sales Agreement between the Customer and the Seller.
- Sales Agreement – a Product sales agreement concluded or entered into between the Customer and the Seller via the Online Store. A Sales Agreement also means - in relation to the features of the Product - a service agreement and a contract for specific work.
- Proof of payment - an invoice or receipt issued in accordance with the Act on Tax on Goods and Services of 11 March 2004 and other applicable laws.
- Payment - payment to the Seller's account via online payment methods available in the Store or payment upon delivery of the Product - depending on the chosen payment method and the ordered Product.

- The Customer may communicate with the Seller using the addresses and telephone numbers provided in this paragraph.
§ 4
Technical requirements
For using the Store, including browsing the assortment to use the Store and place orders for Products, the following are required:
- a terminal device with internet access and a web browser,
- an active e-mail account,
- cookies enabled,
- FlashPlayer installed.
§ 5
General Information
- To the fullest extent permitted by law, the Seller is not liable for any disruptions, including interruptions in the operation of the Store, caused by force majeure, unauthorized actions of third parties, or incompatibility of the Online Store with the Customer's technical infrastructure.
- Browsing the Store's assortment does not require creating an Account. The Customer may place orders for Products in the Store's assortment by providing the necessary personal and address data to enable the Order to be completed.
- The prices listed in the Store are given in Polish zloty and are gross prices.
- The final (final) amount payable by the Customer consists of the price for the Product, of which the Customer is informed on the Store's website during the Order placement process, including when expressing the intention to be bound by the Sales Agreement.
- In the case of an Agreement covering the provision of services for an indefinite period, the final (final) price is the total price including all payments for the billing period.
- If the nature of the subject matter of the Agreement does not, reasonably, allow for the advance calculation of the final (final) price, information on the method of price calculation, as well as service fees and other costs, will be provided in the Store in the Product description.
§ 6
How to use the Store
- The Customer is obliged to use the Store in a manner consistent with the Regulations, legal provisions, principles of social coexistence, Internet customs (Netiquette), and good manners.
- The Customer is obliged in particular to:
- refrain from actions that may hinder or disrupt the operation of the Store, in particular those that may hinder the use of the Store by other Customers;
- not provide false personal data;
- refrain from actions that may violate the privacy of other Customers, in particular collecting, processing, and disseminating information about other Customers without their individual consent, as well as refraining from not to violate the confidentiality of correspondence;
- not to use the Store's website – even indirectly – to send unsolicited commercial information;
- update the data necessary for contact;
- refrain from actions that damage the good name of the Store and entities cooperating with it;
- refrain from any actions that violate the privacy and good name of other people;
- not to post on the Store's website or transmit through it any content or materials that are contrary to applicable law or the rules of social coexistence, vulgar, obscene, or pornographic content, content generally considered offensive, or content that violates the personal rights of others;
- not to use someone else's image, not to incite others to commit a crime, not to promote violence, and to refrain from morally reprehensible conduct that violates good manners. and the rules of Netiquette;
- refrain from other behaviors that could be objectively considered as clearly undesirable, reprehensible, or contrary to its intended purpose.
§ 7
Principles of Placing an Order
To place an Order, you must:
- accept the Store's Terms and Conditions,
- select the Product that is the subject of the Order, and then add "Add to Cart" (or equivalent),
- complete the Order Form by entering the recipient's details, i.e., first and last name, name, email address, and address to which the Product is to be delivered, Tax Identification Number (NIP) in the case of Entrepreneurs, select the type of shipment (method of Product delivery),
- confirm the order by clicking the link sent in an email,
- choose one of the available payment methods and, depending on the payment method, pay for the order within a specified period.
§ 8
Offered payment and delivery methods
- The Customer can use the following payment methods:
- Traditional transfer
- Przelewy24
- PayPal.
- The Customer can use the following delivery or collection methods for the ordered Product:
- DPD, DHL courier shipments
- InPost parcel lockers.
- Detailed information on acceptable payment methods can be found on the store's website.

§ 9
Execution of the Sales Agreement
- The Sales Agreement between the Customer and the Seller is concluded after the Customer places an Order online or using the order form in the Online Store.
- After placing the Order, the Seller immediately confirms its receipt and simultaneously accepts the Order for processing. Confirmation of receipt of the Order and its acceptance for processing occurs by the Seller sending the Customer an appropriate email to the email address provided by the Customer when placing the Order. This email message contains at least the Seller's statement of receipt of the Order and its acceptance for processing, as well as confirmation of the conclusion of the Sales Agreement. Upon receipt of the above email by the Customer, a Sales Agreement is concluded between the Customer and the Seller.
- The Customer is obligated to make payment within 7 days of placing the Order – otherwise, the order will be canceled.
- Products available in stock will be shipped by the Seller within 1 day of the payment being credited to the Seller's bank account. Estimated delivery time: Poland - 1-2 business days, Germany - 2-3 business days, European Union - 2-5 business days, other countries - DHL Express - from 5 business days. In the case of ordering Products with different delivery times, the delivery date is the longest given date. In the event of an extension of the delivery deadline, the Customer will be informed by the Seller.
- In the event of ordering Products with different readiness dates for collection, the Customer has the option to collect the Products in parts (depending on their readiness for collection) or to collect all Products after the entire order is completed.
- The period for the Product's readiness for collection by the Customer begins on the date the Seller's bank account is credited.
- The Customer may collect the Order in person.
§ 10
Right of withdrawal
- The Buyer, who is a consumer within the meaning of Art. 22(1) of the Act of 23 April 1964 - Civil Code (Journal of Laws of 2017, item 459), pursuant to Art. 27 of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended), the Buyer has the right to withdraw from a distance contract without giving a reason within 14 days from the date of receipt of the Product.
- The above right does not apply to the Buyer in the following cases:
- provision of services, if the Seller has fully performed the service with the express consent of the Buyer, who was informed before the commencement of the service that after the Seller has performed the service, the Buyer will lose the right to withdraw from the contract,
- contracts concerning services for which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before the expiry of the withdrawal period,
- contracts for which the subject of the service is a non-prefabricated item, manufactured according to the Buyer's specifications or intended to satisfy their individual needs. needs,
- contracts whose subject matter is an item that spoils quickly or has a short shelf life,
- contracts whose subject matter is an item delivered in a sealed package that cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened by the Buyer after delivery,
- special contracts whose subject matter is items that, due to their nature, are inseparably connected with other items after delivery,
- contracts whose subject matter is alcoholic beverages, the price for which was agreed upon at the conclusion of the Sales Agreement and delivery can only take place after 30 days, and their value depends on market fluctuations over which the Seller has no control,
- contracts in which the Buyer expressly requested that the Seller come to them for urgent repairs or maintenance. If the Seller provides additional services other than those requested by the Buyer, or supplies items other than spare parts necessary for repair or maintenance, the Buyer has the right to withdraw from the contract in respect of additional services or items,
- contracts for the provision of audio or visual recordings or computer programs supplied in a sealed package, if the package was opened by the Buyer after delivery,
- delivery of newspapers, periodicals, or magazines, with the exception of a subscription agreement,
- agreements concluded by public auction,
- agreements for the provision of accommodation services other than for residential purposes, transport of goods, car rental, catering, services related to leisure, entertainment, sporting, or cultural events, if the concluded agreement specifies the day or period of service provision,
- agreements for the provision of digital content, not recorded on a tangible medium, if the performance of the service began with the express consent of the Buyer before the expiry of the withdrawal period and after the Seller informed the Buyer of the loss of the right of withdrawal.
- For effective withdrawal from the contract referred to in point 1 of this paragraph, it is sufficient for the Buyer to submit a declaration by electronic means or by mail, in The statutory 14-day period from the date of receipt of the shipment.
- When withdrawing from the contract, the Buyer is obliged to return the Product together with proof of purchase or a copy thereof within 14 days from the date of submitting the withdrawal.
- The shipping costs of the returned Product are borne by the Buyer.
- The Buyer is liable for any decrease in the value of the Product resulting from its use beyond what is necessary to establish the nature, characteristics, and functioning of the Product.
- The Seller guarantees the refund of the Product price and the costs of shipping the Product to the Buyer immediately, no later than within 14 days.
- The Seller will refund the payment using the same method of payment that the Buyer used, unless the Buyer expressly agreed to a different method of return that does not involve additional costs for the Buyer.
- If the Buyer has chosen a method of delivery other than the cheapest standard delivery method offered by the Seller, the Seller is not obliged to refund the Buyer any additional costs incurred by the Buyer. costs.
- Returns of Products upon withdrawal from the contract, sent at the Seller's expense or cash on delivery will not be accepted.
- The provisions of this paragraph do not apply to Buyers who are not consumers within the meaning of Art. 22(1) of the Act of 23 April 1964 - Civil Code (Journal of Laws of 2017, item 459), i.e. persons performing legal acts directly related to the business or professional activity they conduct on their own behalf - in their case, the right to withdraw from the Sales Agreement is absolutely excluded.
§ 11
Complaints and warranty
- The Sales Agreement covers new products.
- The Seller is obliged to deliver the Customer a defect-free item.
- In the event of a defect in the goods purchased from the Seller, the Customer has the right to make a complaint based on the provisions on warranty in the Civil Code. An entrepreneur acting as a natural person may have warranty rights if it is demonstrated that the transaction is unrelated to the business activity conducted, and thus has acquired consumer rights. The provisions governing consumer rights related to warranty will apply to such individuals.
- Complaints should be submitted electronically to the following email address: biuro@grelkam.pl using the complaint form on the Store's website. Complete forms are available at: https://grelkam.pl/content/10-zwroty-i-reklamacje. The form should be sent to: ul. Trzebnicka 6, 50-245, Wrocław. The product and the form should be returned to the warehouse address: ul. Wiosenna 23, 55-114 Kryniczno. It is recommended that the complaint include, among others: a concise description of the defect, the circumstances (including the date) of its occurrence, photos of the damaged product, details of the Customer submitting the complaint, and the Customer's request in connection with the Product defect.
- The Seller will respond to the complaint immediately, no later than within 14 days, and if it fails to do so within this period, it is considered that the Customer's request has been deemed justified.
- If a warranty has been granted for the Product, information about it and its content will be included in the Product description in the Store.
§ 12
Out-of-court complaint and redress procedures
- Detailed information on the Consumer's ability to use out-of-court complaint and redress procedures and the rules for accessing these procedures are available at the offices and on the websites of district (municipal) consumer advocates, social organizations whose statutory tasks include consumer protection, Voivodship Lodz Trade Inspection Inspectorates and at the following websites of the Office of Competition and Consumer Protection:

- The consumer has the following examples of possibilities of using out-of-court complaint and redress methods: claims:
- The consumer is entitled to apply to a permanent consumer arbitration court, referred to in Article 37 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to resolve a dispute arising from the Contract concluded with the Seller.
- The consumer is entitled to apply to the provincial inspector of the Trade Inspection, in accordance with Article 36 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings to amicably resolve the dispute between the Consumer and the Seller.
- The Consumer may obtain free assistance in resolving the dispute between them and the Seller, also using the free assistance of the district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (including the Consumer Federation, Association of Polish Consumers).
§ 13
Personal Data in the Online Store
- The controller of Customers' personal data collected via the Online Store is Seller.
- Customer personal data collected by the administrator via the Online Store are collected for the purpose of fulfilling the Sales Agreement, and if the Customer consents, also for marketing purposes.
- The recipients of the personal data of Customers of the Online Store may be:
- In the case of a Customer who uses the Online Store's delivery method by post or courier, the Administrator makes the collected Customer personal data available to the selected carrier or intermediary carrying out shipments on behalf of the Administrator.
- In the case of a Customer who uses the Online Store's electronic payment method or payment card, the Administrator makes the collected Customer personal data available to the selected entity handling these payments in the Online Store.
- The Customer has the right to access and correct their data.
- Providing personal data is voluntary, however, failure to provide the personal data specified in the Terms and Conditions, which are necessary to conclude the Sales Agreement, will result in the impossibility of concluding the Agreement. Agreements.
§ 14
Final Provisions
- Agreements concluded through the Online Store are concluded in Polish.
- The Seller reserves the right to amend the Terms and Conditions for important reasons, including: changes in legal provisions, changes in payment and delivery methods - to the extent that such changes affect the implementation of the provisions of these Terms and Conditions. The Seller will inform the Customer of any changes at least 7 days in advance.
- In matters not regulated by these Terms and Conditions, the generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on the Provision of Electronic Services; the Consumer Rights Act; and the Personal Data Protection Act.
- The Customer has the right to use out-of-court complaint and redress procedures. To this end, you can submit a complaint via the EU ODR online platform available at: http://ec.europa.eu/consumers/odr/.
